Ideology of Pancasila as Legal Ideas (Rechtsidee) for Indonesia Nation
Abstract
Abstract
Pancasila is the five principles that provide the basis for the The Unitary State of the Republic of Indonesia (NKRI) to establish an independent, sovereign, just and prosperous state. As a sovereign state, one of the conditions that must be met is to have the rule of law. Law became commander in forming a sovereign state. The law serves to show that a nation is able to regulate the state in a legal corridor of law. Law becomes a benchmark in building a just nation. In forming the law of course requires a basis or principle as the source of all sources of law. Pancasila as the basic principle of the state, provides the foundation for the formation of law.
Pancasila as the basis of the philosophy of the State and the ideology of the nation and state, is not only for a series of beautiful words but they must be realized and actualized in various fields in the life of a nation and state. Pancasila as the basis of the state shows that Pancasila as the source of all sources of law or source of all legal order in the Republic of Indonesia, this means that the existing laws and regulations in Indonesia should be based on Pancasila as the legal basis.
All legal products must be in accordance with Pancasila and should not be against it. Therefore, if Pancasila is changed, then all legal products in the State of the Republic of Indonesia since 1945 (Proclamation) until now, automatically the product of law is no longer valid, or in other words, all legal products from beginning to end, all “void ab initio” because the source of all its sources of law is not sourced from Pancasila. Therefore, Pancasila can not be changed and can not be changed according to agreed consensus and become the source of all sources of law in Indonesia.
